  1. Scope of Application

These Terms and Conditions apply to the use of the website https://curteaberarilor.com/ and to online orders placed through the website for food products, beverages and other products available on the menu.

Orders placed through the website are available for personal pick-up from the restaurant. The website https://curteaberarilor.com/ does not offer its own home delivery service. For orders with delivery, customers may be redirected to external delivery platforms, such as Glovo, in which case the order, payment, delivery, cancellation and customer relationship are managed according to the terms of that platform.

  1. Definitions

For the purposes of these Terms and Conditions:

– "Customer" means any natural or legal person who accesses the website or places an order.

– "Consumer" means the natural person acting for purposes outside their commercial, industrial, production, craft or liberal activity.

– "Order" means the request submitted through the website for the purchase of one or more products.

– "Products" means culinary preparations, beverages and/or other products available for online ordering.

– "Pick-up" means the collection of the order by the customer from the restaurant, at the address indicated at the time of ordering.

  1. Acceptance of Terms and Conditions

By accessing the website, using its features or placing an order, you confirm that you have read, understood and accepted these Terms and Conditions, as well as the policies published on the website, including the Delivery/Pick-up Policy, Cancellation Policy, Privacy Policy and Cookie Policy, as applicable.

If you do not agree with these Terms and Conditions, please do not use the website and do not place orders through it.

  1. Products, Menu and Food Information

Products available on the website are presented with their name, description, price and, where applicable, information regarding ingredients, allergens, quantity or other relevant characteristics.

Product photos are for illustrative purposes. The appearance of the final product may vary depending on ingredients, availability, preparation method, packaging and presentation.

We make efforts to ensure that product information is correct and up to date. However, errors, recipe changes, temporary unavailabilities or minor differences from the information displayed may occur. If an ordered product is not available, we will contact you for replacement, order modification or refund of the amount for the unavailable product.

If you have allergies, food intolerances or dietary restrictions, please check the information displayed on the website and contact us before placing your order at office@curteaberarilor.com or 0213.137.532. Although we follow internal food handling procedures, products may be prepared in a space where allergens such as gluten, eggs, milk, fish, crustaceans, soy, peanuts, tree nuts, celery, mustard, sesame, sulphites, lupin or molluscs are used.

Products containing alcohol, if available for ordering, may only be purchased and collected by persons who have reached the age of 18. The Restaurant may request the presentation of an identity document at the time of order collection and may refuse to hand over alcoholic products if age cannot be verified.

  1. Prices and Taxes

Prices displayed on the website are expressed in Romanian lei (RON) and include VAT, unless expressly stated otherwise.

Prices may be changed at any time without prior notice. Price changes do not affect orders already confirmed by the Restaurant.

Website prices may differ from prices available in the restaurant or on external delivery platforms, including due to commissions, promotions, service charges, packaging fees or the commercial policies of those platforms.

  1. Placing Online Orders

To place an order through the website, the customer selects the desired products, fills in the required details, chooses the available payment method and submits the order by clicking the order completion button.

The customer is responsible for the accuracy of the data provided, including name, phone number, email address, pick-up time and any special notes entered in the order.

By placing the order, the customer declares that the information provided is correct and agrees to pay the value of the ordered products.

  1. Order Confirmation and Acceptance

After placing the order, the customer may receive an automatic order receipt confirmation via the website, email, SMS or other available communication means. This automatic confirmation attests to the receipt of the order, not necessarily its final acceptance.

The order is considered accepted by the Restaurant at the time of its confirmation by the Restaurant or at the time of commencement of order preparation, as applicable.

The Restaurant reserves the right to refuse or cancel an order in justified situations, including but not limited to: product unavailability, obvious price or description errors, fraud suspicions, inability to contact the customer, technical issues, inability to prepare the order within the requested timeframe or non-compliance with these Terms and Conditions.

  1. Payment

Accepted payment methods are: online card.

In the case of online payment, the transaction may be processed through an external payment service provider, such as euplatesc.ro. The Restaurant does not store the complete card details used for payment.

If online payment is not authorised or is refused, the order may not be processed.

If a VAT invoice is required, the customer must provide correct billing details at the time of placing the order or contact the Restaurant at office@curteaberarilor.com within 1 day of placing the order.

  1. Order Pick-up from the Restaurant

Orders placed through the website are collected from:

The estimated pick-up time is communicated during the ordering process or through the confirmation sent to the customer. The pick-up time is an estimate and may vary depending on order volume, product availability, preparation complexity or other operational circumstances.

At the time of order pick-up, the customer may be asked to present the order number, the name used for the order, the order confirmation or the phone number associated with the order.

The customer may designate another person to collect the order. The person who collects an order based on the correct order identification details will be considered authorised by the customer to receive the order.

The risk of deterioration, loss, improper handling or consumption of products transfers to the customer at the time of order handover.

  1. Home Delivery

The website https://curteaberarilor.com/ does not offer home delivery through its own service.

If you wish delivery, you may be redirected to external delivery platforms, such as Glovo. Orders placed through such platforms are subject to the terms and policies of that platform. The Restaurant does not control and is not responsible for delivery fees, delivery times, application operation, payment methods, cancellations, refunds or services offered by external platforms, to the extent that these are managed directly by the platform.

  1. Cancellations, Returns and Right of Withdrawal

Order cancellation is governed by the Cancellation Policy published on the website.

Food products prepared to order, perishable products, products liable to deteriorate or expire rapidly, customized products, and sealed products that cannot be returned for health-protection or hygiene reasons once they have been unsealed are exempt from the right of withdrawal, under the applicable legislation, including G.E.O. no. 34/2014.

Once the order has been accepted and/or preparation of the products has begun, cancellation may no longer be possible, and the amounts paid may not be refundable, except where the order cannot be fulfilled by the Restaurant or the product is non-compliant due to the Restaurant's fault.

  1. Uncollected orders

If a confirmed order is not collected at the communicated time or within a reasonable interval after that time, the products may become unfit for consumption, may lose their optimal quality, or may be disposed of in accordance with internal food-safety procedures.

Orders that have been prepared and not collected are non-refundable, except where the failure to collect was caused by the Restaurant's fault.

  1. Complaints regarding orders

If there is a problem with an order collected from the restaurant, please contact us as soon as possible, preferably within 1 hour of collection, at office@curteaberarilor.com or 0213.137.532.

To resolve the complaint, we may ask you for the order number, the receipt/invoice, photos of the product, the product packaging, or other relevant information.

If the complaint is well-founded, the Restaurant may offer, depending on the situation, replacement of the product, remaking of the order, full or partial refund of the amount paid, or another solution agreed with the customer.

  1. Use of the website

The customer undertakes to use the website in a lawful and responsible manner and not to engage in activities that may affect the operation, security, or availability of the website.

Using the website to place false, fraudulent, abusive, or inaccurate orders is prohibited.

The Restaurant may restrict access to the website or refuse to process orders in the event of abusive, fraudulent use, or use contrary to these Terms and Conditions.

  1. Intellectual property rights

The content of the website, including texts, photographs, menus, graphic elements, trade names, logos, and presentation materials, belongs to the Restaurant or its partners and is protected under the applicable legislation.

Copying, reproducing, distributing, modifying, or using the content of the website without the prior written consent of the Restaurant is prohibited, except for personal and non-commercial use permitted by law.

  1. Personal data protection

We process customers' personal data in accordance with the Privacy Policy available

Personal data may be processed for receiving and processing orders, communicating with customers, processing payments, issuing fiscal documents, resolving complaints, and fulfilling legal obligations.

  1. Limitation of liability

The Restaurant makes reasonable efforts to keep the website functional, secure, and up to date. However, we do not guarantee that the website will operate without interruptions, errors, or temporary unavailability.

The Restaurant is not liable for damages caused by improper use of the website, the provision of incorrect data by the customer, failure to collect the order on time, improper handling of the products after handover, or the use of external delivery platforms.

Nothing in these Terms and Conditions limits consumers' legal rights or liability that cannot be excluded under the law.

  1. Force majeure

The Restaurant shall not be liable for the non-performance or delayed performance of its obligations in the event of force majeure or fortuitous events, including but not limited to: utility outages, technical problems, breakdowns, fires, floods, restrictions imposed by authorities, strikes, epidemics, the unavailability of suppliers, or other events beyond the Restaurant's control.

  1. Amendment of the Terms and Conditions

The Restaurant may amend these Terms and Conditions at any time. The version applicable to an order is the version published on the website at the time the order is placed.

 

Continued use of the website after the changes are published constitutes acceptance of the updated version of the Terms and Conditions.

  1. Governing law and dispute resolution

These Terms and Conditions are governed by Romanian law.

For any complaint, please contact us first at office@curteaberarilor.com or 0213.137.532, so that we can attempt to resolve the situation amicably.

Consumers may turn to the National Authority for Consumer Protection (ANPC) and to the alternative dispute resolution mechanisms made available by the ANPC, in accordance with the applicable legislation.
